Legal fees and other costs are important considerations when discussing a workplace injury matter. Ask your solicitor to explain the proposed arrangements before deciding whether to proceed.
Understanding the costs
Solicitor fees are only one part of the picture. Depending on the matter, other costs may include medical reports, expert reports and court-related expenses. Ask which costs may arise, when they would be payable and who would be responsible for them.
Questions to ask your solicitor
- How will professional fees be calculated?
- What expenses or third-party charges might arise?
- When would payments fall due?
- What costs could remain payable if the matter does not proceed or is unsuccessful?
- Could there be a liability for another party’s costs?
- What happens if the matter settles or you change solicitor?
Agreeing the arrangements
We explain the applicable legal fees and other costs before you decide to proceed. The arrangements for your matter should be set out clearly in writing. Do not assume that making an enquiry, pursuing a claim or reaching a settlement means that no costs will arise.
In contentious business, a solicitor may not calculate fees or other charges as a percentage or proportion of any award or settlement.
